37 CFR 7: THE NEW TRADEMARK REGULATIONS TO IMPLEMENT THE MADRID PROTOCOL

Transformation -- § 7.31
  • When the International registration is cancelled in whole or in part as the result of a cancellation of the basic application or registration in an action that began in the first five years after international registration, the international registrant may "transform" its U.S. extension of protection

IF

  • The Holder of the international registration files a TEAS request to transform within 3 months of the date of cancellation of the international registration
  • Request must include pertinent data and new application filing fee
  • The new U.S. application will retain the same filing date and same priority as the prior extension of protection
  • The holder of the international application must claim and perfect a new basis
  • If a registered extension of protection is "transformed" it will be put back into application status and given a new serial number
