- § 74 of
the Trademark Act provides: When a
United States registration and a subsequently issued certificate of
extension of protection to the United States are owned by the same person,
identify the same mark and list the same goods or services the extension
or protection shall have the same rights that accrued to the registration
prior to the issuance of the certificate of extension of protection
- Section
gives rights to the extension of protection by operation of law
- § 7.28
provides a means for the USPTO to note the relationship between the
certificate of extension of protection and the prior U.S. registration
- A simple
electronic form will be used to note replacement
- This form
will effect a notation in the USPTO's electronic records of number of the
prior U.S. registration
