37 CFR 7: THE NEW TRADEMARK REGULATIONS TO IMPLEMENT THE MADRID PROTOCOL

General Approach to the Rulemaking
  • Keep it simple
  • Write rules that clarify how to work with the Office
  • Don't write any rules about the WIPO process itself
  • Match electronic forms/computer requirements with the rules
  • The rules do not address the requirements that the Protocol imposes on the USPTO or the transactions between the USPTO and WIPO
  • There are requirements in the Protocol that are not addressed in the U.S. regulations, e.g., all grounds for refusal (by USPTO) must be raised in the first 18 months
